Thanks for understanding my post I did not know how it would come off to you when you read it. I was just trying to give you what the corporation mind set will be. I hope that it works out for you and post the results. Remember do not give up the fight. The only thing you have to loose is paying "1/2" for it so all you have is gain to win!! It is not like your car is sitting at the dealership and you can not drive it so keep at it.

I am on a same boat with 2004 X5 3.0L engine. The driver side seat burned a hole on the seat and on my pants. I called dealer I bought a car from but a Kid smartly declined and said "Oh really? I haven't heard about this at all" I will call BMWNA Monday Morning and see what they say. This is way out of warranty but this is a safety issue. I wouldn't call if my engine or tranny fails. But this is something went wrong during design. What do you guys recommend ?

Well.....the most BMW is willing to offer is to pay for half the seat replacement after haggling with them for over a week. I guess it's better than nothing at all. They said the offer to pay for half will stand as long as I own the car so no rush to get it fixed right away. Probably do it sooner than later however.

I got a call from BMWNA and they want me to go to a dealer of my choice. I am expecting them to pay half but I need it to be fixed without hurting my pocket. In my case my seat, pants and my butt got burned so I am not going to spare them. I will Sue them if they do not fix it at no cost. I will go to small court and file a lawsuit. They will end up paying more and no kidding. Don't spare BMW guys. This is safety issue. Volvo is taking care of their customers as that happen to their cars as well

Not so lucky here on the left coast, after much back and forth between me, dealer and BMW Canada, they declined to pay a cent towards my sourced seat(which am sure would have a hole if it were not for me turning the heater off in time)....

Take them to small claims court for the max amount you can (NJ is $3K).
BMWUSA will send a local BMW dealership to deal with the arbitrator if it goes
this route. In the end they did pay for the entire repair.
