Its the spring that pops the door open, the spring won't stay down, it should go down when pressed, going to go to bmw and buy the new part tomorrow and install it.
Got the part (10 bucks) and replaced it, all better now..thanks for the input!

Excellent! Have never really looked that hard at the mechanism, was it hard to replace?

This doesn't sound quite right, unless they have changed since my 2004 car. There is a spring which pops the door open but there is a latch that catches it when pushed shut and release when pushed again. Sounds like that catch is not working properly, especially if it stays shut if you hold the door closed then lock the car. When you lock, a secondary catch holds the door shut, pushing it or not. Sure you can pull it a bit and it has some play but it should catch to close and your's is not doing that. Sounds like a trip to the dealer...
No, the spring you are talking about only raises the door up so you can grab it with you hand and open it up all the way. If you have your gas door already opened, you can demonstrate this by pushing the button in and seeing it latch, then pushing it again and seeing it unlatch. This buttom does not grab onto the door at all. With the gas door shut and without pushing the door in first, just grab the edge and pull it open and you will see what I mean. If ImSort0fABigDeal's door is just sitting partially proped opened, then this button latch/spring is not locking down. If it is all the way open, then the hinge spring is not working correctly. I assumed it was popping all the way open. Either way, it sounds like a part needs to be replaced.

Yeah MDT is exactly correctly, its the spring in that button that was broken.

Thanks again

Gotcha, thanks for the clarification. I was indeed talking about the spring that raises the door, but clearly I'm not as familiar with the mechanism as I should be before I start spouting off incorrect answers!
