Many thanks to Dandle for the last reply. Most informative and answers all my concerns/questions.

I will leave my filter out and keep eye on oil level and when I've done a few thousand miles check the state of the air filter/air filter housing and see what impact - NOT filtering the air in crank breather housing - has had.

Atleast with nothing there I am assured that I will not pop any seals (if they have not already been damaged already).

Topic closed for me for the time being.

Next one will be to do auto gearbox and axle oil change... looking to source filter/sump and gearbox oil...at less than dealer prices.

Its up to you if you leave it out but be aware the separators are fitted for a reason. You will end up with oil soaking into your air filter which will make it hard for the engine breath the intake air it requires, you may be creating more problems that your solving. Plus the fact you will go through air filters much quicker so there isnt really any saving over just fitting a new breather. If you do leave it out don't wait to long to check you air filter.

That said my car (M57N2 as well) had only covered 40k miles when BMW decided the breather was contaminated and needed replacing even though I argued it couldn't. You can buy the two new seals for it and just pull it off an clean it from time to time. It certainly won't do any harm and you can see if it does ever get oil deposits on it. That is probably the route I would take.
Errm, Dunno if this has been contested since you wrote this BUT the 535D has a different breather to the 530D...fact!check realoem

Your right. Sorry for the duff information. Even the breather on the pre LCI 535d which looks the same and has no separate oil separator has a different part no to the LCI 530d breather.

Try going to: realoem.com Lookup subsequent model years to find the part you want.

I decided to remove the loo roll after reading that a version of the engine m57n2 (I think) was manufactured with no filter in the housing.

I have not blocked or disconnected any piping... just simply removed the filter.
So the should be no fumes into the engine bay as the pipe still goes around to inlet as before.

I would not expect smoke from exhaust unless there is lots of oil in the crank air that finds its way to the inlet.

I have rank car for 300 miles and no problems or error codes (fingers crossed).

I read that when filter gets blocked this can have -ve impact on engine turbo (starves it of oil or something) so taking out filter should help turbo if anything.

I will report back if enything else crops up but I am not ecxpecting any unless like I said there is lots of oil in the crank air that comes around to the inlet.

Open to other peoples comments and experiences

Check out the diy on here, it's simple enough.
can I ask how the breather filter can effect the expected life of the turbo? My car is a 2005 535d it’s smoking Badly and leaking oil from the exhaust manifold area I have changed the breather filter but still have the problem it’s looks to me like excessive crank case pressure
