I don't have this problem, mine is a little different. Sometimes I hit my remote when I get out of the car, hear the beep, and walk away. When I get back to my car it's unlocked, like it never did lock, which is REALLY worrisome.
Might not be related, but I've noticed that when I lock my doors from the inside of the car, if the back doors don't lock then sometimes the fronts will unlock themselves again after a few seconds. Have you checked that the car is fully locking all doors and fuel cap etc. when you walk away?

This sounds like a software problem, but when I had the E36 I had a similar problem that turned out that the wire harness inside the trunk was worn off from opening and closing the trunk and it affected the wires that controlled the central lock mechanism.

my passenger rear door would not lock as well. I would have to unlock and lock the car several times while driving to get it to lock. the problem went away after the car was in for a seat sensor recall. knock on wood, hasnt happened since

How did you find out that this was the cause of the problem? Had my e60 at the dealers today and they can't find anything. I'm guessing any further investigation will be costly as the car is out of warranty

Just to update this, I got the software updated to the latest version and my problem (both rear doors failing to lock) hasn't happened since
