Comfort Access not working consistently

I have an '06 550i with comfort access, but unfortunately the system does not work the way it is intended. I have two fobs for the car. One is brand new that I bought from the dealer, the other is the one I got with the car and it had the battery replaced. With either fob, the system does not work properly when I try to unlock or lock the doors.
They work fine when I'm starting the car, but I can grab the door handles to unlock the car and nothing happens. Locking it is similarly frustrating as I touch the handle all over trying to get it to lock and it rarely, if ever, does like it is supposed to.
Since one of these fobs is basically brand new and the other has a new battery, can anyone suggest the root of the problem that doesn't involve the fobs themselves?

Not a expert on comfort access as its not an option on my 2010 535..however, when my welcome lights stopped lighting up regularly or the seats not moving into position... It ended up being a battery issue. As the battery dies, it cuts out non needed functions to save battery life for start up. Batteries in BMW last about 5 years...check the date on the battery. Just a thought.

Just to rule out operator error, in your owners manual it explained how you should place your hands and thumb. I normally put my hand in just like I'm opening the door but without pull and it unlocks. When locking its very similar but sometimes my thumb needs to touch the round lock part. I have an LCI so not sure if pre LCI is e same. I know our F10 to lock all you have to do is touch the tooth handle with be finger.

Change the battery in the key fob. The car does NOT charge the battery in the comfort access key fob. A weak battery will cause intermittent function of comfort access. But, you should see a battery/key icon in the instrument cluster (upon start-up) if the battery in the fob is weak.
