If the VIN year digit on a car has a "6" it will be a 2006 MY car for all regulatory and commercial purposes here in the U.S. I appreciate that things are different elsewhere but that's all the counts here in the land of crappy roads and onerous speed limits. I don't like the lamed brain system either but it is what it is.
Now all we need is a U.S.-spec car so we can look at the VIN.
Perhaps going forward we need to clarify some arbitrary "BMW Model Year" as that which is associated only with some date in September and a "U.S. Market/Regulatory Model Year" as that which is determined by BMW's decision or obligation as defined by U.S. regulation.
The MY doesn't change yet. MY changes in September.
Now all we need is a U.S.-spec car so we can look at the VIN.

I'm not saying that new features make a new model year. Running changes (like the Week 9 ones) happen all the time. All I'm saying is that if BMW (or BMWNA in this case) decided to sell the new 525i/530i as 2006's because of CAFE issues or just plain marketing if the cars have a "6" in the 10th position of the VIN they are 2006 model year cars for our purposes. To discuss them as 2005's, again within the conext of the U.S., would only be confusing.
Our definitions of model year simply differ and we'll need to allow for that ambiguity when discussing it.

Your defintion of model year is not the same as the legal definition that we go by AND use here. That's how they are different. Europe does not use the year digit in the VIN so you guys can keep calling them 2005 and we'll call them 2006. That's why the ETK does not embody the idea of model year at all. It relies on the month/year of manufacture which is only sensible. The reality is that even your concept of model year is a fiction that is based on an arbitrary date that traditionally has been associated with change overs. It's quite possible that the 2005 (August) and 2006 (October) 525i/530i cars in Europe will not be different from each other except from a marketing perspective.
How can the MY differ? The factory changes the MY, not a marketing guy at BMWNA...

No. A 2007 model year vehicle can't be sold in the U.S. until Jan. 1, 2006. Makes it easy that way. Any change introduced in September would be running changes as far as the U.S. is concerned.
Note, I am not saying that model year 2006 will start now, in September, or next January. I don't know and won't until I see either BMWNA documentation or a car. What I've been trying to convey is that model year 2006 for the U.S. will start when the first U.S.-spec car with a "6" in the 10th position of the VIN shows up. Model year 2006 for elsewhere will start whenever that regional subsidary of BMW decides.
