535 Transmission Problem

My Ride: 2008 535i, platinum gray with cream beige dakota leather, premium, sport, comfort access, navigation, heated seats, sport auto with paddles, premium sound, sat radio, ipod
I have an 08 535 with sport, 28,000 miles on it. When I get on the gas and put a load on the transmission, my car starts to "skip" intermitently as if the gear is slipping. This is most noticeable when driving at highway speeds and then accellerating. Will also reproduce when rolling along around 30 mph or so and then giving it the gas. Doesn't seem to skip in the lower gears nor when driving gently around town. Just when putting a fair amount of load or tork on the drive train.
Took it by the dealer and service manager drove the car. He did notice the "effect" and said since no warnings were produced then no codes would have been thrown. Suggested that I bring it back in 2 weeks to a month when the BMW field rep was in town so he could drive it. Then went on to say that "it could be normal operation for this car". SAY WHAT??? (Funny, the car didn't drive like that the first 20,000 miles I had it!)
History - HPFP replaced at 7000 miles. #5 cylinder misfiring at 24,000 and car was reprogrammed. Battery replaced at 26,000 miles.
Any ideas on what this is? Anyone else with this? Any bulletins out on this?

Where in the south east are you located? Kind of vague....
If you are in a larger area ( Charlotte or ATL) you can take it to a different dealer.
Other areas you could look up the other dealers in the area if you are willing to drive.
Are you having these issues on fairly level grades or are they steep hills? How about from a Dead stop, or coming from a dead stop ( say like 5mph then accelerating again)
Any Leaks?

Could possibly be a MAF sensor problem? Could even be the fuel you're using...

I agree with the above too. But I would also check the MAF Sensor. My M5 had a similar problem to this last year. Kind of surging under load... I went to my local BMW M Specialist, and they checked both MAF sensors (you'll only have 1) and one of them wasn't "recognising" the air coming in as well as the other. They replaced the Left Bank MAF Sensor, and problem solved! Also a friend of mine who had a 550i M Sport LCI was experiencing these problems and he found it was the fuel he was using! Seriously! He usually ran the car on Shell V Power, but one day he had no option but to put in a different brand called Tesco, (Uk E60ers will know them, it's an English Supermarket like you guys have Publix and WalMart etc), and the car ran like a bag of s**t! he ran that tank dry and put in V Power and after about 100 miles of the V Power being used, it was FINE! A month later, Tesco were in the newspapers under criticism of bad fuel and damage to peoples engines... Just goes to show how much the fuel can affect your car!
At the least, it's worth testing, as it could prove to be a nil cost fix if it's the fuel (bar the tank you buy). And if it's MAF, then that is a cheap part in the world of BMW's!

Yes, if it's not tranny related, than this is likely the alternate diagnosis. These dealers don't want to touch anything until a code is thrown so I don't know how we are going to narrow this down!
