I wrote a 3 page letter explaining to the dealership why the BMW NA rep's argument was weak and how blaming a loyal customer like me just because he can't explain why 2 clutches and flywheels failed in 10K miles was wrong and I really just wanted the same car without defects. And I said I had no option but to pursue the lemon law to protect myself - especially after they told me that they would not replace it again!!

They called me today and told me they will take the car back at full value - all of my persistence payed off.

I am very dissappointed in the BMW NA so-called regional engineer - his conclusion that I was at fault was soley based on the rear tire treads! So wrong and so short sighted - especially when the shop foreman - who knows these cars inside and out -- said it was most likely an imbalanced flywheel that was causing the issue.

I go in Monday to talk with the sales guy and decide what car I want to get next - I am thinking of getting the same exact car - I would love an M5 but not sure how much more $$$ it would be on a lease

It sounds like turbo lag... Sorry, just needed to prod my 550 buddies.
I would call BMWNA directly to discuss the issue and keep detailed records of all conversations and correspondence. I would read your states Lemon Law in detail because if you write off your car for income tax reasons then its no longer for personal use and under New York State Lemon Laws, it's no longer protected. So see what MA laws states. Good luck!

You should definitely consider... I personally think it's worth the extra money if you are leasing the vehicle. You have nothing to loose! You get a great SMG transmission. No lag what so ever under any circumstances.... And you don't really need to do anything to it to make it "better". They say you only live once... Do it!

Went to the dealer yesterday to see what it was going to cost me to replace the car.

Getting a 2010 550 6sp - they are using the trade-in assistance program to basically buy out the lease - payment going up $30 per month. Not bad - now you get nav, hd radio, ipod/usb integration as part of a FREE value package.

Also the sport package is now the M sport package - m sills, footrest, steering wheel, shifter and supposedly m suspension (it might be the same as the 2008 550 suspension). It is the same color as my car (carbon black with grey interior). It is in RI so I should get it in less than a week - 7 weeks for a custom build - only losing rear shades by going for the quicker replacement.

Glad they finally decided to do the right thing - BMW NA called me today to appoligize for me having to go through the battle. Still love BMWs - not so much the regional "engineers"

On a different note, I didn't have as much appreciation for the speed of the M5 as I have now. This 550i has no balls compared to that car, and it's depressing me as of late. Another Ford Taurus actually tried to race me tonight (one tried prior with my M5 also ). The outcome in the 550i was obvious, but it certainly didn't perform like I would have liked. It took forever to get to 120mph with my foot mashed to the floor, after dropping down to 3rd gear when I was doing 80mph. Rode it all the way to redline between shifts, and it was just plain weak.

This really has nothing to do with your problem, but I just needed to post my frustration as of late with the mere 360HP car.
Sounds like it's time to return to a M5.
