Confirms my theory that BMW are nowadays overstating average MPG claims by around 5mpg.
I currently have a new shape 320d SE Touring which should average 48mpg but even with lots of motorway miles struggles to get over 44mpg (and that's with just me on board and no luggage). My previous' old generation' model avearge 48mpg over 80k miles and yet the new one is supposed to have better MPG!!!
I'm ordering a 5 series now and have driven 2 or 3 diesels (525d and 530d) all of which seemed to average at least 5mpg worse than claimed economy. The new petrols (523i, 525i and 530i autos) are all supposed to average 37.7mpg but I'm reckoning on around 5mpg less (looks like I'll be going for the 525i). Only problem is I can't verify that as no UK dealers have a petrol demonstrator!!

I got my 520d on 02 October 07. My clutch pedal graons in exactly the manner you have described.

Averaged 44.8 mpg over 3450 miles. Not what the brochure states, but damn impressive for a big car, particularly since I'm driving it quite hard.
