The other thing I can think of is related to the metal grinder theory posted earlier -- is it possible that somehow at the factory the car didn't get properly prepped after some minor grinding but before the color coat?

Overall I am very disappointed with this car. Other issues include Active Cruise turning off randomly, rough idle, rattling windshield, rough running for the first 10 or so minutes after starting, inconsistent accelerator pedal.
See this thread for possible info on rough engine issue.

These spots are actually on the surface of the paint. It is not the metal under the paint rusting. The other thing is that most of these spots are on the panels right behind each wheel and on the back. So either the brakes are causing the problem or I drove through something. I'm pretty sure the brakes are causing this.

Congrats on the Steelers victory by the way!!! Good luck at Indy

I remember spots like this occasionally on my wife's celica. They normally would buff right out. I figured it was polution or something - but it always freaked me out.

BTW, can I ask what car you had before this?
and..
Do you like the perforated seats?

Find a good detailer. You defintiely drove over some IOWA road scum. Plastic bumpers dont rust.

looks like road tar to me. Do you have or have you considered mudflaps?

WTF, this is no rust. He has it even on plastic bumper! Rust ???
it is tartar (asphalt) from roads. Use some asphalt remover and your car will be like new in a second!!!!
you just drove over some very new road, or road construction....

rust on plastic hahaaaaaaaaa. you got me there.
sorry but I get mad when people blame everything on the car or BMW and they don't even think for a second there. oh well....

Clay does remove these spots. I will be claying for the rest of my life though. So it is something landing on the paint not the car itself that is rusting. And they are definately rust, all of them are orange. Not tar.

Think I have bad brake pads or rotors.

I am actually going to leave them on the car so that the dealer can see them.

Just got done pressure washing the car and noticed some "dirt" was not coming off...It's not dirt -there are rust spots all over the place. I noticed a few of these a few weeks ago and thought it was a little strange. Got rid of them with clay then waxed the car. All of these have shown up in the last 2 weeks. I know a few of these are normal. I owned a white x5 for a few years and was used to removing these with clay. But this is insane!!!!

What could be causing this??? Is this a paint flaw or something else?

Overall I am very disappointed with this car. Other issues include Active Cruise turning off randomly, rough idle, rattling windshield, rough running for the first 10 or so minutes after starting, inconsistent accelerator pedal.

Try to clean the paint up on your own... there are more than a few horror stories here about dealer-inflicted paint damage. I wouldn't trust anyone other than a highly reputable detailer (or my own hands) to do a job of the magnitude your paint is going to require.
