guys,

same problem here a load of lies from bmw, gearbox operates exactly as yours do

i have rejected the car and taken it back to the dealer on friday 17th March, i have told bmw finance that i will not pay them any more money for the car and left the car at the dealer who is some 85 miles from my home

legal action is already underway but will take some time to sort

if you don't mind then please send me a direct massage so i can get a list of all disgruntled sufferers it might help

the next problem is-- get rid of this piece of junk and get what???mercedes-nope, jag-definately not, audi-well maybe but not sure ah yes a vauxhall, at least when you buy a vauxhall you expect it to be crap and you wont be disappointed and it will cost a lot less so you can smile when driving your crap car

seriously though please leave me a message and i'll get in touch and share information VIn numbers etc is a good way of recording affected cars

Just read an article in BMW Car Magazine - "Longtermers Bad Vibrations". The reporter describes the fault and asked the dealer what the fault is. Dealer replied (as if preprogrammed) "It's not a fault, merely a feature of the auto gearbox. Basically, the car moves off in 2nd gear because of the amount of torque to preserve the internals of the gearbox"

If that isn't an admission of a serious fault then I don't know what is! Interestingly, though my car does end up in first gear after sitting at a junction long enough and pulls out fine without cogs flying out of the transmission, it only happens when you've come to a rolling stop and then try to pull out. So speaking as an automotive electronics engineer it is simply a timing issue in the software or if the transmission can't cope with the torque then it is a serious design defect that requires a new transmission.

I've thought that the software was wrong from day 1 as the car changes gear far too often and unnecessarily resulting in approx. 22-24mpg. The way to get some form of redress (if that is what you want) is to make a claim in the small claims court for the difference in mpg e.g. I have a 4 year contract hire agreement; my e39 returned 36mpg so I'm claiming for (40k miles x (36mpg-24mpg) x ?0.95) which is about ?2400. As this is under ?5k the cost is ?250 and both parties have to pay their own costs.
Before submitting a claim you need to write to them stating that if you don't get a fix (or wahtever you've asked for) within 14 days you intend to take legal action at the same time you will ask the court to issue a joint litigation order where adverts are placed asking for people with similar complaints to join in.

Why do this? BMW can afford more lawyers and if action goes against you you get the bill for their costs. They rely on you being too sensible not to take this route but the small claims is different and provides you with an option that will make them offer a resolution for little cost and risk to you.

Just spoke to my dealer after reporting this back in Jan, ongoing ever since..I've been waiting for the s/w update but apparently CIP 18.xxxx and after have not addressed any issues to transmission slam. In fact they say that there have been no direct adjustments to the E60 s/w and trans. There is nothing in the pipeline and they will raise a Puma...! There is a speacilaist in Bracknell who will come out to see it if the "re-training" that they are planning nect week is unsuccessful. The retrain consists of multiple decelerations etc etc....!!!!

The 'specialist' will be the same guy who I saw.

Waste of time, he works for ZF who make the gearbox, chances of him admitting they have produced a crap gearbox are about the same as me growing tits overnight !

HI MY E60 IS IN THE DEALERS NOW FOR 8 DAYS GOT A NEW TRANSMISSION AND HAD TO BRING IT BACK AS IT WAS NOT WORKING SAME PROBLEM

I am suffering the problem of delayed throttle response on my 530d Auto, car creeps while revs increase, then car suddenly snatches the gear (1st) and then races off. Been back to the dealer countless times over the last 6 or so months and they still say its a characteristic of the car. The wording in the article in BMW CAr Magazine is virtually word perfect as to what my dealer told me on the subject. If it was the case that there was 'so much torque' then why is there not a widespread problem with the 535d Auto. I wonder hopw many people it would take to force BMW to conduct a recall to rectify the problem?

That's really correct way.

If the Top Management does not get lots of direct "complains", the guys down there will just be pressured for the Profit targets.
But as soon as the Top Management feels that there's no smoke without a fire (particularly when there's something threatning the QUALITY image of the brand) believe me, the pressure on those who should in the first place assure that such problems do not exist is huge... Everything and everybody gets questioned... Nobody is innocent....

Been there, done (or should I say suffered) that!!

But one short question, did anyone driven similar cars to its but without this problem ??
Is this a problem in all Cars with the ZF gearbox or someone around there does not feel it?
There's a good link above, to a Jaguar Forum describing perfectly the default (with animation...).

Its that I'm being delivered the my family E61 525dA next Wednesday and would not like to be surprised by this default...
I have lots of kilometers in a E60 530dA from my company, and never noticed such a failure...

It is about 50/50 in terms of owners suffering this problem. A little surprisingly petrol owners seem to have a slightly worse issue than diesel, which does not tie in with the explanation given by ZF.
