I didnt get the rims yet I order them yesterday lol i just want to get everything I need before hand ... Miro Time Attack 19x8.5 in the front and 19x9.5 in the rear (staggered set up) gonna be getting Goodyear Eagle Gt 245/35/19 front and 275/30/19 rear ... I have a 530xi which has an offset of 43 and I believe the rims are 38 in front and 40 in rear

Remember, your "car" itself doesn't have an offset per se. The ET43 is the typical offset that BMW uses for their 18" rims (123's) and ET43-F, ET55-R for the 124 staggered rims.

If your front Miro's are ET38, I wouldn't touch them with spacers. The same goes with your ET40 in the rear. The max you could do is around 8mm in front and back, which isn't worth it IMHO.

Here's an ET45 in the rear with the same sized rims and tires you have, to give you an idea.

Thanks for in the info ... I thought I needed spacers for a proper fitment since the front and rear wheels have different offsets

I'd pick up those 12mm spacers at a reasonable price, if you have the bolts too...
