do what you gotta do, but you already know lawsuits will take years and years before any payment is made. Being that you and you family have injuries to include your children their insurance may offer "limits" on the other drivers insurance. any scarring or lasting injuries you and your child has will warrant significant payout as well. I would at least entertain the insurance company's offers... good luck and happy to hear u and your family are safe.
