i got scammed like that before.. i owed 15K for the car when i was selling it. the guys from "dealershi" bought the car and signed the paper that they will transfer money to my bank to pay it off. Later my bank called and said the car was never paid off. Apparently the "dealer" disn't have a license anymore and that paper he signed was nothing.
luckuly my bank freezed the account and investigated the situation. it's been 2 years since and they wrote off my loan (i'm not sure what happened to those guys)

He called me 4 days later stating that my car was great and has been registered with his DMV and passed emissions.

Now I know why I'd rather trade in my cars (yes, I know I get less for them) than deal with private buyers. So much easier and better, the only cars I have sold privately have all been cash transactions, someone should have told this guy to tell the buyer "when I get the $$$ you get the keys - not before"
If you do decide to sell private party and still have a loan on it, go through the dealership. My last truck was a lease that I had for a year. I found a legit guy to buy it and we both decided to do it at the dealership. The dealership did charge a $500 "transfer fee" that the buyer and myself decided to split, but I got confirmation that everything went through and processed, I slept well that night.

Does the guy even have a case? He gave away the car for $0. It's all in the papers he signed.
