If true the check itself is a contract and demands performance. If the check was issued with a stop payment the receiver can demand performance on that contract. The car sale itself, regardless of how it happened, is not his best leg to stand on, especially since it was done in a less than legal manner. I'm not a lawyer but did take legal classes for my degree and I did stay at a Holiday Inn Express last night.

Now I know why I'd rather trade in my cars (yes, I know I get less for them) than deal with private buyers. So much easier and better, the only cars I have sold privately have all been cash transactions, someone should have told this guy to tell the buyer "when I get the $$$ you get the keys - not before"
