Phil, first off, sorry about your unfortunate case.
I would call that guys dad back and tell him what his son has done. I would tell him the full situation and see if his dad will pay you back. (Be Humble) If this was not resolved, you WILL take him to court and file a police report. I am sure where ever you did the transaction there are cameras showing the deal.
Look into it a bit further before you do anything rash. GL buddy.

ask a friend to respond to one of his ads. take pictures of everything (the box, its contents etc) while at the meeting with him. then you will have proof. then take his ass to court and get his low life ass to pay you back.

Sorry to hear about the scam.
To be completly honest here... I would do the following,
1. Call him back, ask him to refund your money or else.
2. I would get a black marker, and write "I'm going to kill you" on the side of the xbox
3. Wipe off xbox, and throw it threw his living room window.

Not so sure that will work. Since in the post-9/11 days of the Patriot Act that is called "Making terrorist threats" and gets you in a LOT of trouble.

Sorry about what happen to you Phil. Chalk it up to experience and move on. Karma will catch up to his ass soon enough. I think if you take him to court you will have to give proof that he misled and lied to you about the condition of the product. Not an easy task and you would have to do the heavy lifting. He?s already called you a liar. He will stick to his story tell the judge the same thing, that the item he sold to you was brand new. You will have to prove your case that it wasn?t. He?s innocent until you?ve proven him guilty.
Before buying electronics from a private party always open the package first, inspect and test it out. When they refuse to open it then don?t buy. This guy has some balls to try that stunt. Imagine if the buyer (Phil) had to open the package in front of him?
Once in a while you guys probably run into those people on the road driving a van trying to sell you home electronics like speakers for cheap. Man some of those characters are aggressive con-artist and extremely shady. You have to watch out for those people
When I?m selling stuff I always encounter these meticulous buyers who look at every little angle. Bugs the hell out of me, but I understand.
