Ok So I was surfing ebay and saw an ad from zenmotorsports for a carbon fiber roof spoiler. I took a double take and saw that it was a picture of my car with the cf roof spoiler I kindly emailed the seller stating that I was the original owner of this picture and that he either remove it or compensate me. Of course he stated that the picture was not my car bla bla bla... So I obviously have the original pictures about a dozen or so I took that day. Now I actually don't mind if he used it but don't take credit for something he did not do. Had he asked me once he realized he was in error I would of been cool with it but his remarks and outward lies pissed me off. So now whats my next step??
Personally, I wouldn't care as long as my license plate wasn't displayed. I mean come on, its an E60 and your car looks good. The dude clearly loved the pics. To me, its flattering. Life is too short to care about stupid shit.

You know your right life is too short and I was flattered at first but when I confronted this idiot, his sly slick ass responses pissed me off  . So you know what he dosen't deserve to have a picture of MY car on his site which he is representing as his own. He's not worthy...lol I'm sure you wouldn't like it if someone else was taking credit for something you did..I don't see that sitting well with anybody. Its the principle of it. Just be honest ...Had he told me that he got it from where ever and like it and used it and if I didn't mind then you know what i would have been ok with that. I have gotten several emails in the past from vendors asking for a photo of a product installed on my car that I have purchased from them and had no problem with sending them one.

Log onto Ebay. Click the following link:

Report Ebay User/Listing

Under reason for report, choose Copying of your Listing

Under Detailed Reason, choose Report your picture or description was copied without permission

That'll put it under official notice and they'll be notified to remove the picture.

True, if he was an ass about it I would get pissed, too.

Usually, when you disseminate a photo of an object (not a person) to the public (no copyright protections) you waive any confidentiality or ownership. It may be determined that when you post a photo of a car on a website you relinquish your rights to claim exclusivity (ie Copyright Act ). Good luck with your effort.

I think you are mistaken with that one - I don't know too much about this. A copyright is a tangible expression in a fixed medium. He took the picture and it is his copyright.

Objection!

The copyright remains!
You are not waiving your rights just by making it public!
