lol, no there is nothing written...it wasn't anything to be concerned about, I wouldn't make him write anything saying he would never charge me you know??
Take it from me who has been in a lawsuit. If it's small claims, it may not cause you monetary loss but you will get a headache nonetheless. If it is a full blown lawsuit (something like over $5000), it will cost you in lawyer fees (which will add up, trust me on this one) and a large headache. The lawyer's fee can easily more than the suit amount when the dust settles.

Now, you may be thinking, this is stupid, and I'm going to fight to the end. I want some justice. If so, claim down. Justice is pricey, very pricey, and most of the time, you win in court but loss in the end. Sometimes (most of the time), you are right, but courts consist of people, and people are subjective. Asshole lawyers will play on jurors' emotions and win the trial.

Did you actually get served with the lawsuit or is he threatening you? If latter, sit down, calculate how much the parts cost, see if it's worth it, either return the parts, pay him, or ignore him. If you have been served either with small claims or by his attorney, you have to get an attorney yourself. That's a dark path, so good luck.

Ok, the best way to summerize this is that a friend of mine and I both had the same cars. i spent countless hours working on his car and in return he gave me parts for it. Now almost a year later he is filing a lawsuit against me saying I owe him the money for the parts.

My question is this...I have never gone through this before. I have since moved and the lawsuit is filed in my county here. Does that mean he has to come here to fight this out in court?

and if this does go to court do I have the option of seeing what kind of evidence he would be bringing for his case

and of course, any advice?
Don't worry about evidents yet. It'll cost you thousand of dollars to see it, and thousands more to disprove it. Decide if you want to settle or proceed with litigation.

For every ethical lawyer, there are 3 unethical ones. Just because you hire a good lawyer doesn't mean he is ethical.

guess its the same in the US, if you ever agreed on this in even "oral version", kinda' agreement btw you and your friend? than he is in trouble- you fulfilled what you said you deserve the parts.

If he wud have said he gives you for free that is an act of giving a present, but you worked for him he did not paid you, so again you deserve the payment= parts.

Get a lawyer as they need your money Sorry could not resist, but do it faster.

Of course be prepared that you have to proove all what happened also him and the better "tale" wins, good luck man
