Because the shop did it for me. The problem is that the shop that does it for me is not an ATT authorized dealer. So she can get me out of the contract and into a new one with rebates and free phones again, but it doesn't help me as I want to get a ATT phone b/c their reception is better.

Since a shop can do it and call on my behalf, I was thinking if there has got to be a way to find out what they tell them. I guess not....

PJ you can start PW now

Thanks for the background info. Now I understand what you're trying to accomplish. Getting out of current contract and resign with the same one "YES", but I don't believe you can do that between 2 different companies. I could be wrong. GL

Some of the small cell phone shops in my area can do it, but I have to sign another contract with them. If they carried ATT as well then it'll be all good. I just figured if they can do it, they probably is a "secret" way.
Verizon cancelled my acct with Alltel. I was 2 1/2 years with Alltel on a 2 yr contract , the charges out of area were insane. My wife had the alltel phone replaced under their warranty program, un beknownst to us that exhange started the contract again and alltel sent us a $150.00 bill.

Talking in person with managers and being threatened to be taken to collections by head ho we relented and paid, just to keep my BP under 200/300.

Bottom line no early termination.

That's shady that replacing a phone under warranty would renew a contract automatically (I assume they didn't say that upfront). I'd dispute that and call BBB on them.

Ok Bulldog, let the "whore games" begin

+1 File a complaint with the BBB and the FCC and they will investigate. I would also review and make copies of all the related paperwork you got with the replacement phone, because them "renewing" your contract just because the phone was defective is BS.

Check to see if your contract provides for the ETF to pro-rate after a qualifying period. If you've had the phone for a year, your ETF may well be subject to a pro-rata deduction (i.e. if you're halfway through the contract your ETF is lower than for a recently signed deal). This is reasonably common, may mean your ETF is lower than you thought it might be.

I stuck it out with T-Mobile before getting our iPhones... but give this a try:
  1. Find a friend or relative who lives in an area which doesn't get T-Mobile coverage.
  2. Have them add your name to a utility bill per se.
  3. Once the docs are in place, call up T-Mobile and tell them that you've moved, or
spend more than 50% of your time in an area which they don't provide coverage for.
  4. There's no justification paying T-Mobile's bill when you're only getting a fractional benefit.
  5. T-Mobile will cancel your contract with no fees.
Alternatively, whenever a policy change with your T-Mobile contract is about to go
in effect, check for additional fees etc. Call them up and state that you do not agree
with these charges and would like to be out of your contract. Again, no additional fees.

Good luck.

I want to get into ATT b/c Tmobile reception sucks in my area especially at my g/f's house which is where we have the mailing address at, but not enough to justify getting a cancellation (I tried calling).
I've used T-Mobile a few years ago and I didn't like their coverage, so I know what you mean.

However, I also have AT&T and I'm definitely NOT impressed with their service or coverage. My contract is up next year and when it does I'm switching again - probably to Verizon.

GL getting out of paying the ETF.
