there is not a chance that will fly at night ... especially in Fairfax...you will def. get pulled over and they'll be able to ticket you for driving at night w/o headlights if they feel like it...
+1

You're just asking to get pulled over in Fairfax or Montgomery County MD.

Fog/driving lamps and AE's are technically not headlights. And, even if your fogs are as bright as or brighter than headlights, they are NOT headlights. If you need a more technical explanation, GOOGLE it!

It maybe splitting hairs, but why would you intentionally want to give a police officer one more reason to pull you over and write a ticket? Is a potential fine your contribution to balancing your state's budget?

If so, have at it ... your legislators need all the money you have and will spend it gleefully
+2.

Regardless of the brightness of AEs or HID fogs, the law generally requires headlights to be on at night and during rain. Not having your headlights on in these conditions is a nice easy ticket for a police offer to write.

It's absolutely amazing the amount of people that drive in this country and don't read their drivers' handbook. You all took the initial test to obtain your license, yet ignore the basics! Headlights are required to be on from dusk to dawn, raining, and under foggy conditions. All other lighting is optional. Sheesh!

i think the question that needs to be asked is "what defines a headlight?" is there a measurement. surely the AEs provide better lighting than some of the old beaters i have driven. How do you determine what "headlights" are.

come on people, lets not beat up the op. silly, yes, but we need to discuss whether the AE could be defined as a headlight from a legal standpoint, not the BMW owners manual. BMW didnt issue him the ticket.

I live in Arlington, VA... I can ask some local cops I know.

FYI - I -never- drive like that, with parking lights only or with parking+fogs. Maybe it's the part of me that's German, but I don't think it's proper.

Headlights are required for visabilty, for the driver and other vehicles on the road.

I can't recall the exact specs but low beam 150 ft ',highbeam 300 ft.

Yea it's an easy ticket to write IF YOUR LIGHTS ARE OFF.
