here is the thing, there is no way of actually knowing what camera he used to take those pictures, he could have used his d200. I cant prove what he did or didnt use to give those examples and considering his unwillingness to help out over $40 it leads me to think it was a "ok you got a good price, but there is a problem with it that i wont tell you about now go fuck off" approach
If they smudge isn't in the photos and they were taken with that camera within a reasonable time prior to your purchase, I'd say you're SOL and need to accept the fact that the camera was used. If the smudge is there, then you have a beef with the guy...

i paid $350 for the camera so that kinda puts it in context that $80 expense for something like that makes the camera not such a good deal anymore for me IMHO

PTL: Don't worry about the smutch itself. It's normal that some dust and stuff get on to the sensor of a DSLR sometimes. Cleaning the sensor is just a regular maintenance procedure you have to do. To me it sounds like if you had bought a bicycle and you'd like to get a refund from the seller because of a slightly leaked tyre. It would be great if the seller assisted with the cost, but I don't think he will.
I suggest you purchase a good quality sensor cleaning set for the future. Like Sensor Swab here!
