That depends on the state. Most states have signs that say something like "speeding fines doubled when workers are present". GA does not do this. As long as an area is labelled a construction zone, the reduced speed limit applies regardless of day/time/workers or equipment being present.

I found this out the hard way too.

Sucks. Call one of those "traffic law" attorneys who advertises on late night TV. It's one totally corrupt practice I endorse wholeheartedly. It's all about revenue.

No you are wrong. I don't have the access of my research printouts right now, but reduced speed limit at construction zones DO NOT APPLY 24hrs a day.
I'll try to dig up the folders to quote you exactly later(not for couple weeks though as I'm out of state till after thanksgiving).
Meanwhile, I believe it says something like after each work day is over, they must revert back to its original speed limit of that road if the conditions of the road is
safe. I remember the word 'SAFE' is ambuiguous as it doesn't specify exactly what's safe and what's not. But one thing for sure is, workers can't leave the construction zone unsafe to public motorists. So that means, after the work day is over each day, they must do things like barriers and other stuff to make it safe for its drivers, then
revert back to its original speed limits.
One more thing, you see that the construction on the road is over miles ago but still 'construction zone is in effect' for miles after passing the actual construction? That's illegal as well. The law again doesn't specify the distance in numbers but it indicates to keep it short to bring the traffic flaw up as soon as possible. But normally, they do not post the construction zone is over 'sign' until couple miles past. Illegal.

You lost because you were uninformed. Judges and everyone won't tell you this. So, if you receive a ticket let's say at midnight at construction zone when they weren't present, you have 99% chance to win it due to what I listed above. The speed limit they enforce is illegal at THAT TIME OF THE DAY.
That's how attorney/lawyer fights the ticket and win it. They know every single detail of the law. There are some incompetend lawyers out there where they always do plea bargain.

Don't quote me on exact words as I do not have access to my research. I'm trying to give you a base info. My research could be wrong or the law might have changed since but I spent about $300 on speeding ticket/traffic ticket laws, books etc and 2 weeks of my free time so I'm very confident about it.
