Should I cancel the contract??

Today was supposed to be a happy day for me... I signed a contract on a demonstrator BMW E61 530i M sport Wagon in carbon black, dakota leather, 19 inch rims, a beautiful car done only 2500kms. 3 months old. New N2 engine...

Thing is that the sales person told my wife and I that TV was optioned and that the road tax for this car was stil valid for six months, I made my offer based on this as part of the overall criteria. When I asked to see th vehicle, he was most reluctant to show it to me, and so we just looked at it form the outside and went back to the show room to negotiate the price etc... so after signing the contract, we insist on seeing the car and to our great disappointment.there was not TV option. At this point my wife is pretty upset because of two things. 1. no TV and second 2. only one month road tax left.

The sales person did apologise and say that it was his mistake, but when we asked how he was going to rememdy the mistake, he basically said, it is still a good deal anyway and you don't need the TV. He was very flippant about the whole thing and even when we pushed for some rectification, he said, if you are not happy, there is nothing I can do and we can go upstairs to tear up the contract. When I then asked him whether a TV could be retrofitted, he said no. But going through REAL OEM on the web, I find that there is a retrofit option. He has lied to us again.

We are upset also because the previous day, we had passed up a great deal in Melbourne on another wagon which was more highly specced and about $15K cheaper just to do the deal in Adelaide. Now I am not very happy. What do you think? I still have not paid the deposit.

dont tolerate dealers doing this to you! walk out and search for another car... This is totally unacceptable

this is very bad behaviour and can't be tolerated. I would not believe a single word this guy has told you. I would be suspecious that there is more wrong with the car than just the TV option.

As your contract should specify the car including the options you should speak to the guys manager to get a discount equivalent of the missing option or cancel the contract and speak to BMW about it (provided this is an authorized dealer). Somebody has got to sort this guy out.

Can't believe you signed a contract without having the chance to see the vvehicle and check over a=in detail. Have you driven it?

On the otehr hand, can't see why a TV is a priority for a drivers car, particularly as the screen size is so small / poor clarity.
If you really must get a TV surely far better to spend your money on a laptop and run from this - far bigger / better screen size (and you will only be using for rear seat passengers or stationery anyway)

we had test driven three other vehicles we were considering from this particular dealership and they were as described, there was no reason to doubt the description on this one. The TV is important for the wife. Its not whether there is or is not a TV, it is the fact that they told me there was one and there wasn't, this would have affected the price I would have been willing to pay for the vehicle. I know full well I can retro fit better stuff. Its more the attitude. When you are shelling out that kind of moola for a new car, you expect at least some sort of customer service?? that is the bee under my bonnet.

But from my point of view I walk out right after not showing me the car.
sounds like you will get more bad things coming up if you do buy the car.
If you have not payed the deposit then walk out and go and try the cheeper 1.
just other con artest cowboy sale person.
I would have say to the sale person "you can stick the car right up your A**" and walk away

well good luck and alway look at the goods before you buy or sign

My advice is to rescind the contract.

Buy the vehicle in Melbourne, which the dealer will be able to deliver to you in Adelaide by truck. With the money you save on the vehicle in Melbourne you should purchase an extended warranty for the vehicle. I live in Melbourne and bought a carbon black E61 demonstrator in Sydney because I was unhappy with the higher price demanded in Melbourne by Stillwells for an older, higher mileage vehicle.

My fellow friend, look you dealer CHEATED you,

you had your intention to sign the contract, in the will that you will get the TV option too.

You then made alreadyin oral a contract which is binding for both of you. Now if he sold you the car without the TV insist on this fact or step out of the contract, which I know is more difficult then to sign in.

Sorry I do not wanna be smart ... but I am sure would insist on showing me the car, test it!!! on the road and all functions, check the background and then may be if all is OK with that car I sign.

YOu can aslos say the "forced" you that if you do not want it, get off...

But they have NO right not to show you the car that you are willing to buy.

and this is the same in USA and EU and around the World, if needed go to a good lawyer, but at least friegthen your dealer with lawyers, they like 'em GOOD LUCK

and nice forum name, are you goingt to have those parts...mixed

Thanks for all the advice and support, I have approached the sales manager and he is working out a deal for me... but so far has offered this in compensation:

1. BMW M drive day for my wife and I
2. Free car protection kit. Including security window tint, leather and upholstery protection and paint protection.
3. Free rubber mats.
4. Extended registration for 6 months.

I am able to rescind the contract and the sales manager personally will attend to my purchase and has promised me a good deal. We will wait and see.
