E61 tailgate spoiler rubbing/snagging on roof when opening

Hi all,
Just bought an '05 E61 M Sport and am finding that when opening the tailgate, the spoiler is rubbing/snagging on the roofline. Today I opened the tailgate glass only and it was much more pronounced to the point that I'm worried it might shatter the glass at some point.
Does anyone know if this is common, or a symptom of the tailgate needing adjustment or the spoiler being poorly fitted or something?

There are a few bolts that hold the glass and you have a bit of wiggle room to adjust/align it. I would check that. Also, there are 4 bolts that hold the spoiler on and when loose they allow the spoiler to slide up. I personally would try loosening the 4 screws, slide down the spoiler as much as you can, and retighten them.
