whats the matter with the exhaust valve?

Hey guys,
my car, a 530i with 272hp has still the OEM exhaust.
Last time I looked underneath the car, I noticed a valve attached on the 2nd. exhaust tip.
Since then I thought only 545 and 540 would come with the valve, but it seems that I have it also.
The problem: it opens only above 4000rpm I believe..
What would happen if I swap the exhaust from OEM to Eisenmann or Supersprint?
Should I cut-off the valve? Are there any error messages on the screen after I romove the valve?

I think I heard over on E90 post that the computer stores it as an internal fault but it won't through codes on the dash...
