Keep complaining at the dealership and tell them you are tired of this not being fixed. I had to take my 2005 545i back many times before they would replace the transmission! Good Luck and keep us updated on your progress!

They reprogrammed mine last week Friday and I've put over a 100 miles since then and so far, so good.

Edit- Took to Long Beach BMW and dealt with SA Bryan. Randy the foreman came out, when on a ride with him and promptly took care of the issue.

i assume this is referring to the occasional 'kick' that I get when I try to roll forward and instead it bursts forward like someone rear-ended me? Is there a fix for this?

the funny thing is that i only get this symptom in cold starts and not all the time, anybody is having this issues all the time?
It makes it very difficult for any techs to diagnose when something like this doesn't happen frequently and does not illuminate the check engine light. But since i have had the CIP updates it only did it like twice.

that jerking or sudden push in low RPM, does feel like being rear ended.

Mine was the same way...only when cold. I took it in several times to Crevier, but they couldn't fix it. The car porter managed to back my car into a wall or something while it was there. Took it back to Shelly where I bought it and they fixed it on this last go. They said they couldn't duplicate the problem, but updated the software, etc. and I haven't had any problems since. I was pretty firm and told them I would leave it there as long as necessary to get it fixed. They had it 2 days and it hasn't done it once since I got it back about a month ago. Whatever they did, that was what is needed.
I have an '08 535 and did have this issue since day 1.
Best of luck with your issue. I know it is a really annoying problem to have.
