i guess i would have a hard time lying in court. i jumped to this conclusion based on my own convictions. I would fear the repercussion. I need to remember not everyone has the same thought proccess and levels of integrity. alright, i will step off my "holier then thou" soapbox now.... i spend way to much time up there.

I agree with your approach. I always tell the truth to the judge and to my adversaries. If I am faced with a question from an adversary where I do not want to tell the truth, I don't lie. I just decline to answer the question and make a joke of it.

Witnesses, however, lie every day, oath or not. That is why the discovery of documents and emails is so important. People say the studiest things in internal emails.

You are not at fault as your car was hit while parked. Your insurance will pay for the repair 1st and thenl chase after the neighbor's insurance to recover all costs. That's what they do when you have full coverage. GL

make sure your insurance has an endearment for OEM Parts.. depending on your insurance company they only replace with OEM Parts if car is brand new, if its a few years old they can use a aftermarket parts like windshield ect.

Have a police report, but it's up to you about the insurance claim. IF the girl can pay for it out of her pocket, it's a win-win situation because her premium won't sky rocket and the accident won't show up on the carfax for your E60. Now if the girl can't pay then unfortunately you would have to do a claim with your insurance and explain the situation ALONG with the police report.

It's a hassle believe me. I was involved in a 3 car accident where a car got sandwiched into me and the girl, 2 cars back who was at fault, was NOT part of the insurance on the car she was driving so it's taking FOREVER for my insurance to get the money to get my car fixed! If only I had extra money I would just go to the body shop and have my car repaired now and not have to wait for stupid insurance to get on to it.

Thank you all for the advice and responses.

I contacted the guy and informed him that we should exchange insurance information so I can make a claim and put in a police report. He is now denying that he didn't do all the damages to my car and he said that another car must of hit mine. He tells me that I have to call a traffic officer to do CSI on the cars and paint and all this angle bs to determine who hit my car.(a bunch of bs that is not realistic at all) I didn't want to be bad guy, but if he is not willing to work things out. I will just call in a hit and run and inform the officer that he is the perpetrator as stated by my witness. In which more penalties will be given to him for fleeing the scene. Hopefully everything works out ok. I miss my car and I know that it will take at least about a month or close to it to get it fix. I will see what will happen after tonight when I call the officer after work.

Don't do anyone any favors. It is what it is... a hit and run. You need to be honest about it to the insurance company and any police report to cover YOUR ass.

P.S. - Call the police now, don't wait.


EDIT: And now that I see the response right above mine, you can clearly see that some people are crooked son of a bitches with zero honor or morals. That neighbor of yours will get what's coming to him.
