ARGH! That totally sucks. Why was he in gear with the foot on the clutch? and like you said why was he so freaken close?! Ton of dumb people out there.

Thanks guys....you don't know how bad I wanted to "bitch slap him!"

I'll have to get a couple additional estimates and then let the fun begin with his insurance company - which I have never heard of - Dairyland County Mutual

They should enact special laws for individuals who cause an accident with an E-60. I think a 5 year prison term for a first offense and a $20,000 fine would be appropriate. A second offense should be life imprisionment. Anyone trying to contest their guilt would would be subject to capital punishment.

I agree, but the stupidity of it is what drives me insane After talking with him at the scene and on the phone - "the elevator clearly does not go all the way up"

I think you were absolutely right to go through the insurance company. Not only it is a good lesson to him, but also the final cost might be much higher than the initial estimate.

I remember when this happenned to me, I just gave all the info of the other guy to my insurance company and dropped my car off at the body shop of my choice. My insurance company paid for my car to be fixed without any problems and then went after the other guys insurance company on their own.

In the US, is the process different than my experience?

Ouch!

Why just not skip it all and just apply a quick bullet to the center of the forehead, or to be more humane a big fat rubber stamp with red permanent ink that says "IDIOT"

I know that when I am sitting at a stop light I take extra care to not pull to close to the car infront, as you never know they could be driveing a stick and roll back as well.

Sometimes I think it's far too easy to get a driver's license in the U.S. I believe in some Euro countires it is much more difficult. Almost everyday I see at least one driver who just doesn't seem to "get it" and probably never will. How some of them are able to even pass the simple test they are given is a mystery.

Ouch, sry to hear about it. Your car will look after the repair just like it did before the accident, don't worry. I hope the insurance will cover it.
