Wow..they are breaking the law by taking your photo and using it for profit. You should get in contact with him/her and have them cough up a few bucks.

Maybe you should contact eBay about it? I don't use eBay much but I thought they took this kind of stuff pretty seriously. You may have more impact if you cause eBay to contact the seller about the hijacked pics...

Braking the law? Maybe. Make him cough up a few bucks  Or maybe it's the american way of thinking....
Also doesn't that also brake the law?

Aside this, 5Thirty you should really contact ebay about it.

You can't do squat really.

You didn't watermark it, copyright, or do anything related to that. He might take it down out of courtesy, but thats it.

Once it's on the internet, it's free reign.

It's still copyrighted and you can not just use it because it was on the net. Only the one that took the picture can!

If you contact ebay, they will delete it.

Prove to me he took the picture.

Trust me, in US, people jack other peoples pictures/ideas/websites all the time. Only when it is copyrighted at the patented office, you are the sole owner of said picture.

I can right now send in the picture to the patent office and get it copyrighted. I'd be the owner of that picture and if you use it without my permission, I can sue you.

Breaking the law?? Technically, perhaps.

But what's the big deal - he's just trying to show what the grills look like when installed, and they look good. 5Thirty, you should be flattered.

But he can proof that he used it earlier, and that it is his car, and the other dude doesn't even know the adress nor the license plate it is registered under, so in court he would win against the ebay dude...

Anyways...

It's just a pic.

But if it was mine I probably would alert ebay.

You should complain to eBay. However, send the seller "cease and desist" e-mail as well. He/she seems to be popular and power seller, I don't think they will want any trouble. He probably got the picture from Google Image Search or something like that.
