Sorry to hear about your trouble.
My 530D has been with he dealer for 2 weeks having a new transmission fitted. Was supposed to get it back last Friday but there is still one problem that needs to be sorted out (rev counter oscillates up and down slightly at idle and more at about 1100 rpm).
They were going to load CIP 14 but as it's still under development they will load 13.3. My previous software was 13.0.
I have a 735i loaner which I am not enjoying and just makes me look even more forward to getting my baby back!!

Sorry to hear about your trouble.

You know... I have to play Devil's Advocate: This should not happen to a new car, nor should this be an issue with a new car. Imagine buying a new house, and being told that you'll be expriencing problems for the first year so you will have to move out weeks at a time. A 40k car should arrive fault free, none of this fix the car and work out bugs as we go along BS. If this is the case, we should have purchased used cars and had the same woo's.
My car, after several problems with BMW and BMW NA, arrives shortly. I swear to Buddha and on the soul of my son, I will slame BMW with a class action lawsuit and do everything short of trashing the original founders.
For some of you that make a 100K a year behind a desk, 40K is chump change. But my 40K was earned running around the streets of Iraq and Afganistan.

My livingroom wall was inclined and looked like some one has used several days to paint it, so many different shade of white it had. Shower room floor poured water to the hall. One window was broken, kitchen sink was broken, sauna doorpost drop down...
To repair all this took 6 months!
I'm happy now... with my car and our home.

The new module didn't arrived yet.
I'm starting to be sure that i'm not having the car before next week.
I can manage to run the E39 530d some more days but i'm not sure if i can make my wife changing her opinion about the car.
" By the time you get the car, sell it and buy another brand, i don't want to ear about a brand new car that's not working ..... buy a VW Golf she says...."
