Auto closing windows (Turn key) were never a litigation issue as far as I know. I believe I had that on my E39 (could be faulty memory).
What I can tell you is that the windows have a great safety feature that causes them to stop and go down when they encounter an obstacle during closing.
I think my auto hatch has the same function, so I dont see the hazard.

I guess I see this as one of those silly options, like lighted sills and a auto cutoff at 155. But I am ordering the wife a new 650i convert, and the web site says no to the soft close, but the dealer says yes, and the wife has to have it (she says it won't wake the kids up, like the top down at 55 will lull them into a deep sleep.)

But really, soft close doors? What could possibily be next, auto assist exit? Soft close hood? Auto retracting cup holders?

I'll just take cup holders that work!
And tell your wife not leave the kids sleeping in the car, there are laws against that pertaining even to pets, at least she can crack a window for them. (sorry, couldn't help it... I know exactly what she means)

It's really a silly option. You still have to push the door to a position where the the soft close takes effect and the doors w/o soft close do just fine...Careful don't strain yourself!!!!

That makes no sense at all. Are M5 and 7 series drivers more intelligent or less litigious?
It's either allowed or not allowed. Or, its not a question of law suits at all.

Like most things in the business world, it's most likely an economic decision. Why would BMW go to the expense of offering/servicing 5er soft-close doors when it's obvious from these posts that few of us would want them?

Sorry to disagree with some BUT, It's a great feature to have on a car ! My X5 has a soft close rear hatch and it eliminates the need to slam it shut. On cars I'll bet if you look closely to many of your doors there is a "dent" which surrounds your door handle. This is caused by slamming the door while holding your handle , soft touch would help eliminate this by allowing less force to be required to close the door, many other manufactures offer it.I think Soft touch enhances the durability and integrity of your doors and all their working mechanisms if you use it properly this. It should be a Standard Feature on all 5ers .... blah.. blah legal issues aside...... as usual IMHO
