I've played around with the ACC and read the owner's manual and I don't think you can run it without the active part. In the shortest distance setting, it appears to keep about 3-4 car lengths distance from the car in front at about 80 mph. That's really not too bad as you probably shouldn't be closer than that anyway. It actually works really well and adjusts the distance/speed if someone changes lanes in front of you. It goes right back to set speed if you change lanes and there is no car in front.

I haven't experienced it but would think that it might not be as effective on strethches of a road with a lot of curves as it might lose a car in front of you going through a curve.

My thoughts exactly. When I was about to order my car, I went to autotrader.com to look at some used 5's and view their interiors to get an idea of what I would like. I thought the anthracite looked like crap in the photos and ordered the walnut. But when I had to visit the dealer to service my X5 and saw a customer car with the anthracite, I quickly changed my order. It looks awesome in real life.
