I would have them swap if not only out of principal. For your side not having this concern and on their side I am sure they do not what their business represented to you in this way.

My Ride: 2004 545i TITANIUM GREY II on Black Dakota Lthr, Comfort Seats, Sports PKG, Premium PKG, Active/Dynamic Drive, NAV, Winter Package.
These are the same as yours Hankook Ventus V12 Evo K110. I like the tire too I'm only concerned that I might have issues with it later on even thus the cut is not deep. In one of my post I mentioned it's ~2mm deep. I looked at it again this morning it is probably 0.5mm.
