NEW SOFTWARE UPDATE RECEIVED 5-15-09

My Ride: 2008 535xi / Platinum Grey / Black leather / Step Auto / Sport / Premium / Cold weather / 18" wheels / Logic 7 / Comfort / ipod / Navigation / Fold Down Rear Seats / Rear Airbags / Sirius SAT / Spoiler / Extended Clear bra / Bluetooth. (Previously owned a 2002 sport 525I Loaded).
On order: 535xi Platnium Grey with Black interior, Step Auto, Sports package, Premium package, Cold weather package, 18" wheels, Logic 7, Comfort access, ipod adapt, Navigation, Sat radio, Rear spoiler, Extended Clear coat bra.
I know there has been alot of questions regarding the vehicle software updates. This is what I learned today and I hope it will help all of the members inquiring.
I brought my car to the dealer yesterday with a few compliants. One was the Lag when excellerating and the other was the trans slam as you remove your foot from the brake while stopped at a light. For better reference I own a 2008 535xi with sports pack / build date 9/07 which I bought new and took delivery on 10-11-07.
I picked up the car today and it felt pretty smooth at all gears and it felt like it had plenty of power. I was good to some extent because they also replaced the front brakes. I currently have 15,700 miles on the car but the brakes were squeaking a little so they replaced them. I believe the brake in period for the new brakes is about 200 miles.
I spoke to my SA and this is what he related to me.
They just had a new computer overhall about 3 weeks ago and now use whats called the INSTA/P computer. It's suppose to be the newest system out for BMW. The recent version of my software was V.28.0. My issue with the slam was verified and tech stated I had a faulty EGS calibration. The car was programmed and coded including CAS. (don't ask
lolo) I do know it was important. The SIB # for the job was SIB 240308. My new software version is the newest and latest and it's version V3.3.3 or 33.3.
I only drove the car from the dealer back to the office which was about 29 miles. Are both problems fixed?, only time will tell. The car does feel and drive smoother. I will update this information as soon as I have put a couple of miles on the car. I hope this helps all of you.

As some may recall from another post, there is also a recent bulliten (SIB 240309) for software update which includes the 550i, as follows:

It says that the problem is the EGS software (unfavorable NIC ? Neutral Idle Control) calibration and concludes as follows:
"The NIC (Neutral Idle Control) feature disengages the torque converter from the transmission when the vehicle is stationary in the Drive position; the service brakes are applied; and the engine is still in the warm-up phase. The NIC function eliminates engine load when vehicle is stopped, reducing fuel consumption.
Although the EGS software changes (as listed above) are improving transmission comfort feel while still providing the benefits of the NIC feature, they still may not be acceptable for the most discriminating customers.
In such a case, on a customer complaint basis only, deactivate the NIC function by performing the "Converter lockup clutch" retrofit, using the current Progman/ISTA P version."
I assume all E60 members are the "most discriminating customers".
