Missing Oil Cooler?

Hey all. I'm new to the forum, and looking for some help. I ordered a 535XIT due in later this month. I was planning to do the Dinan chip to make it a little more fun to drive, and was told it needs an oil cooler. My dealer told me that some 535's come with and some come without oil coolers. He said it's totally random.
I found out that my car is coming without one. And, they want $2k to put one in at the dealership. Seems odd that the car costs the same, with or without the randomly installed oil cooler, but yet without it I have to pay another $2k for something someone else got for free.
So, I called BMW NA. The guy there told me that if you order it with sport package, it comes with an oil cooler. Well, mine has sport package (along with every other package and most other options). Sorry - try again. Next, he comes back and says that NO ALL WHEEL DRIVE 5-SERIES come with the oil cooler. They only put it in the rear wheel drive ones. So I ask you all, is that possible?
Meanwhile, I emaild BMW NA to try for a consistent answer. Wrong... The response I got from the email said nothing about the all-wheel issue, but came up with another reason - it needs to come with an increased top speed limiter to get an oil cooler. Well, excuse me but where is that option so I could have checked it off and saved myself $2k! I'm patiently awaiting a response to my reply email... I'm happy to pass up delivery of this car and wait a month to save the $2k.
So, does anyone have any thoughts/feedback on this issue? And, more importantly, has anyone taken delivery of a 535xi or 535xit that came with a factory oil cooler?

It was an issue on the E90/92's when the motor first came out. I think only the sport cars came with it at first, then do to so many cars having over heating issues, they added it.
I thought that ALL 535/i/xi/ e61, had the Aux oil cooler due to the lessons learned with the e90's, But this information is some what disturbing. I have a Sport model non IX so I don't think I will be of much help. Mine has the cool on it.
The xi sport package is a bit cheaper ( like $1500) than the non AWD sport package ( $3500 or so ) but I though it was for other reasons (non staggered wheels and less aggressive susp. set up), maybe this is why.

Ditto what bigbadbull said... I knew of the issue on the E90 and how SP equipped cars got the cooler but non-SP cars did not. I too thought all E60/61's got the cooler when the TT 3.5 liter engine was introduced in the 5 series...

I thought on the 08 N54 equipped cars All of them had the Aux oil cooler, as from the lessons learned with the 07 E90's with the retro fit and recall with the N54. I will look in to a bit more .

My Ride: 2008 535i: June 6th start build, complete June 17th, at NY Port July 5th, at dealer July 10th, took delivery Friday July 13- Plantimum Bronze/Natural Brown Leather/Light Poplar, Sport Package, Sport Auto, Active Steering, Premium Package, CWP & PDC. Dinan Performance Software 384hp & 421 ft/lbs.

Its unfortunate but it's not flawed thinking. A different buyer is willing to spend $3500 on a sport option and those drivers generally drive harder so the oil cooler gives you an extra margin of safety. I think the E90 issue was only for cars that were tracked and they weren't having issues on the street.

I remember reading on the Dinan site that the 535 oil cooler was acceptable and didn't need to be replaced. I just looked around on their site, but I couldn't find it again - I'd give them a call (and let them know you have the AWD model).
