thread is a bit confusing.
first about the winshield where you said before there was a 12 inch crack and then now it broke.
secondly, if you returned the car, did you get your check back? or you just returned the car and took the flight to come back without any paperwork.

let us know what happens.

You posted a week ago that you were going to buy this car with a cracked windshield. Now you are saying it cracked after you drove off the lot. It all doesn't add up.

Anyway, read what you signed on the bill of sale. If you accepted it "as-is" then you might be screwed. If the dealer intentionally deceived you into thinking that this car wasn't in an accident, then you 'might' have recourse. You can also check to see if the car was ever salvaged by an insurance company.

Good luck. I think you won't get a lot of sympathy from the forum though. They are probably going to say that you should have known better or had the car independently tested before buying it.

I told you the truth about the windshield. I was looking at a previous one on ebay, I can show it to you if you would like. This windshield was fine when I bought it until a few miles down the road. I dont see why everyone thinks im lying about the windshield, Im here to get advice, not tell lies.

Listen, I was looking on ebay at a 545i that had about a 12" crack in the windshield. This is not the same car. I didnt think flying to TX for a car was a big deal. I have flown to North Carolina as well as NY. There were no 545i with 22k miles that I could get for $25,000 much less one with every option and color combination that I want. Also, I have been looking on ebay and cars.com and half the cars I pulled on carfax had been in an accident. Some had multiple accidents, so I didnt think it was such a big deal.

I called the Attorney General of TX and they said there is no "right of recission" law in TX regaurding returning cars. I thought I could have a stop payment on the check but they already cashed it. I appreciate you guys advice but ultimately I have to make a decision for myself, which I did and it was probly not the right one.

I hope I answered all the questions. I did sign an "As Is" addendum to the contract so I know I am probly legally bound to get the car. The dealership has offered to replce the windshield but I am goint to ask them if they would be willing to ship me the car rather than replace the windshield.

BEWARE OF USED CAR DEALERSHIPS!

I think you said you purchased it from a dealership that only sells used BMW and Mercedes.

Not sure of other states, but in CA, I have been told that the dealerships will not sell a car that has been in a significant accident. Those cars get sold off to 'used car dealerships' or auction.

If you are going to buy a used car at such a high value, I would go certified from a new car dealership, or a very trusting private party and having been checked out by a good mechanic.

ok fine you are not lying.

But how does a broken windshield is a dealer issue?
I mean does it matter where u buy it from? if it breaks it breaks. I am sure they did not glue together a broken glass and sell it to you. So what are the things that you are not happy about.
You said the car drove like a dream then you took off and windshield cracked and it became a nightmare?

From what I have read on other forums the windshield is crap to being with, one guys was cleaning his car and his elbow hit the windshield and it freaking cracked. I mean how much power can an elbow produce while cleaning. So i don't know. Your bank says the car is yours, so this is a tough one.

Also, you haven't asnswered my question. you said the dealer cashed ur check. Did you not get the check back when you returned the car? Some pieces of the story is missing hence people are thinking you are lying.

Seriusly, if you help, just tell the complete story in details - so we can make suggestions that is meaningful.

Well, if the car is legally yours why don't you go and get it and fix the issues. The couple of items you mentioned are not nightmarish. A broken windshield is an easy fix.
Bring the car to a local dealer or mechanic and have them check it out. The creak under the hood could be something minor such as lubrication. If you put a little money into the car it will still be a good deal from a price standpoint. 22,000 miles is pretty low. It should still have some of the original warranty.
