BMW would never be liable for that.
As a driver, you are responsible for the equipment on the car operating.
If you went to the dealer to get service, and they replaced your taillamps....? but didn't do it right, so they didn't operate....?? and a cop pulled you over that night for no taillights...?? you'd get the ticket, not BMW.? And good luck trying to fight that one.

Have you not heard of the woman who was driving with the cup of hot McDonalds coffee between her legs, despite the warnings all over the cup, not to mention the common sense of not putting said cup of VERY hot coffee between your legs. Of course the jury awarded this lady something like $10 because McDonald's makes their coffee too hot, not because she was the dumbf*&k who put the cup between her legs.
God bless America!

ks, you're absolutely right -- except for one small detail: McDonald's didn't start putting warning labels on the coffee cups until after the lady was burned...
It's like the warnings on the instruction page of some clothing irons: "Do not iron clothing while it's being worn!"

If the car is built with a system designed to turn on your lights when it starts to get dark, it had better do just that.?

I'm sure you can get the sensitivity adjusted at the dealer - controlled via software

Yes, I'll do that on my next trip to the dealer, although my expectations are not high, as I remember to have read some other member post saying the sensitivity adjustment was of no great help.

I want to choose the angels while it's not too dark then add the headlights when needed...

I turn the angel lights on, and when it gets dark I put it on auto.
If I am in a hurry or if it's just a short trip, or if I'm simply not in the mood, I leave it on auto and don't care when they come on.
