Just got it back? What did they do to "fix" it the first time? Check w/ GT Premi, he's had similar issues and they are now replacing the wiring harness to try and solve the issue. Also sounds like what Westcoast 550 had and his Canadian dealership swapped out his car for a new one.
I felt about the same as you when it happened to me the second time. It's a joy to drive, but when that reduced power starts happening, I just want to pour some gasoline on it and toss a match! But I have no one to be mad at but myself. I went into the deal knowing how iffy the German cars are with electronics. My sentiment was that I took a gamble and lost. The dealership is going to comp me with two weeks worth of car payments.
And if you reference my post on the "Compliments" thread, some of those same haters are practically salivating and gnashing teeth when they learn my car's in the shop. Just from their comments, I can mentally see them shouting "See! See!" as they go away with that shyte eating smirk on their faces.

... The dealer was required by law to give him back the full purchase price or a replacement car ( took the cash and got a Mustang).

Oh i encounter that problem it said engine malfunction reduce power, I made several trips to the dealer it goes on and goes away. I had to replace my DME. I went to the dealer like a few times they finally figured it out it was a faculty DME and everything has to be reset and reprogram hopes this help.

At the risk of sounding ignorant, what's a DME?

How many times has the same problem happened, Usally in most states if the same problem occurs 3x you can legaly get the car Lemon lawed. You wold have to check with your own state b/c the laws differ. You may want to bring this up with BMW NA/USA. In Georgia/ AL the laws are simular, and when you get a new car they are required by law to give you the information and have you sign off that you have reicieved the info.
The big issue is if the problems have all been caused by the same issue.
I had a friend that got his new vet ( at time a early year C5) bought back by the dealer after 9 months after having replaced 4x new Ecus, new gas tank, fuel pump, 2x e brake cables, falty TPS. The dealer was required by law to give him back the full purchase price or a replacement car ( took the cash and got a Mustang).

they gave me back my car today with no fix! the message is gone and they said the only fault message was i let the gas get to empty (5 miles left) which was a week and a half before this happend with at least 4 or 5 time of me filling it up as i drove from southern california to phoenix over the weekend. so they could find anything wrong and told me to call roadside assistance to tow me to them next time. keep you posted

I'm with BMW of North America, LLC. I've passed this message on to a BMW NA Customer Relations Representative who will be in touch with you soon.

Sorry to hear of your troubles. A friend bought a spanking new M5, had so much problems with it. After more than a dozen or so times visiting the dealer (within the 1st 2 months) they agreed to give him a new replacement. Another one also bought a M5 about week later (from the same dealer) and has been driving his without a glitch. Guess there's an element of luck at play here, so the best of luck
