One of the factors that triggers the lemon laws in many states is the number of days you are without a "comparable vehicle". So if your car is serviced for a month and you are furnished a loaner E60 or comparable for the duration, the state is likely to not consider that time in evaluating your case.
Of course, it's only one factor, so add to that things like 10 times in the shop or 120 days in a single year, even if you're furnished a loaner, and your mileage may vary.
Also, BMWUSA doesn't want you to even take a case to your state for consideration if they can convince you not to.

There are several tests in Texas. One is 30 days out of service. Today is day 45 and tomorrow is day 46. However, BMW NA has 30 days to fix the problem which I believe and hope they will do. If they don't, then the state of Texas will schedule a hearing. I already have a docket number just in case.

They have agreed to pay 1 month lease payment for my troubles.....
I am really impressed ... i am dealing with Crevier and glad i chose them...
my agent Chris has gone above and beyond....
i still have to wait to get my car back but its good to know good customer service still exists...

Another thing to consider is that even though you are paying payment and insurance, they have provided a loaner (which your insurance should cover) and the mileage you add during the loaner period is not being added to your car's odometer. They're like "free" miles to you, particularly useful in a lease. As long as you are in a loaner that is somewhat comparable, it's good.
And since they've agreed to make a lease payment for you in addition, I'd say you're not much the worse for wear, despite the inconvenience.
