I doubt it. the e39 trunk lid isn't as curved, meaning the spoiler will not fit the line of the trunk nicely. why not just get the e60 m5 spoiler? same idea but it fits....

I'll bet you could get it to stick BUT, it won't look anything close to right............... personally I like the old e39///5 trunk spoilers better than the e60 version but you don't argue with the ///M boys in Bavaria
