Crunching / creaking front seat on new E60

I am very happy with my E60 but when I lean back on the seat, I get a loud crunching / creaking sound. Nothing to do with the leather, sounds like the foam inside has become detached. Is this common? Is it a problem to take back to the dealer?

Passenger seat has no such issues?

Please help as I was just beginning to fall in love

I had this problem. The car had only 2300 miles and the area in question was around the right sholder blade. The more I leaned on it to investigate the problem the worse it got. Took it to the dealer and they replaced the back rest cushion. Turns out the plastic seat structure behind the leather / foam had failed.

Thanks - that looks like exactly what has happened to be, will go to dealer (I have only 3,000 miles)
