Sorry to hear that. Did you take pix of the incident? Wish you the best and hope that guy pays for your damage and also put in jail for his behaviour. This time he did it to you car, next time he can do the same to his wife or his children!

Think you might be able to swing it on the 'balance of probabilities' in a civil court. I guess you would probably just need a reasonably independant witness to state that the car was not damaged prior to you setting off that day.

He could argue that someone else could have damaged the car whilst it was parked, but from what you have said it sounds like you did not leave the car.

Since the jerk was not known to you and you called the police etc.. it starts to build reasonable evidence that the guy did something to upset you and that the car was damaged at the same sort of time. All of which backs up your statement that he did it.

and.... no matter what anyone else says - you were right not to whack him.

ughhh I hate vandals, they are just as bad as thiefs and rapists..... Make him pay, get anything and everything outa him...

having an incident like this happen to me just a few weeks ago, i know how frustrating it is...

I think that would be perfectly fair and reasonable under the circumstances - sadly the authorities may not agree.
