Car stuck again-won't go into neutral

My Ride: 2008 535i: June 6th start build, complete June 17th, at NY Port July 5th, at dealer July 10th, took delivery Friday July 13- Plantimum Bronze/Natural Brown Leather/Light Poplar, Sport Package, Sport Auto, Active Steering, Premium Package, CWP & PDC. Dinan Performance Software 384hp & 421 ft/lbs.
Got the car back today. They replaced the SMG Control Module. If this turns out to be the fix I'll post the part numbers. It has taken about a week to run into the problem again.

I had same situation after 1K miles
Dealer ordered new trassmision and it took one week to get it back
now 6K miles later now trouble so far
request new transmission

Bad news. Car stuck again this morning. A little different. This time it was stuck in neutral and it started but I could not get it INTO gear. So I was stuck again anyway. I tried to restart the car but then it got stuck in first and stayed that way, and of course it would not start.
Hopefully it starts in the morning so I can drive it in, since they can't flatbed it in gear. I called the dealer and told them that I have been very patient thus far but this has gotten old, I feel like I'm playing Russian Roulette every time I try to start it.
I will keep you posted.
