It is a general underlying principle of law that one cannot endanger life in order to protect property. This is handed down from Old English Law and the days when people used spring guns and traps to protect their home. You can protect yourself in your own home in most States but only if you feel you are in danger of physical harm.
It would be a bad idea for you to stake out your own car and confront the thief. After all, you don't know what else he is capable of doing. Further, it is a given that if you harm him, in order to protect your vehicle that you will be the one guilty of a crime and probably do more jail time than he would. Crimes against the person carry much longer sentences than crimes against property.

I did talk to insurance. They cover a new key but not the re-keying of the car. When I said that this meant the car was still a liability to be stolen they agreed, but that was the policy. I guess in the grand scheme of things the cost for them to cover re-key'ing a car outweighs the risk of it getting stolen again and then paying out for a new car? Doesn't make sense to me though. I am going to get this done one way or another. I just can't stand paying BMW $275 an hour to do the work.
I would actually worry about how the heck he got the key from the house part first.
