A/C starts w/o my command.

In the past I remember reading a post about "my e60 has mind of its own."
Well I am on same boat.
My 2004 525i A/C starts by itself without my command.
When I turn it off and in about 3-5 seconds, it turns on by itself again.
After about 5 times of repeated turning off, it doesn't happen again.....until the next day or the next time I turn on the engine.
I know my warranty on the car expired 2008 February.
Can this still be fixed under....uhmmm....powertrain warranty?

If it is a BMW CPO car the warranty would take effect after the 4yr/50k and cover more than just powertrain
