Sure they will, I use to deal with buy backs/trade assists/collateral of substitution all the time when I was working at the dealership. But I agree with Branie555 on the trade assist as a minimum settlement. Plus it doesn't hurt to bring it up with the service manager, tell him/her that you've had nothing but headaches with the vehicle and at this point you don't feel safe being in the car, let alone putting anyone else in the car.

I am sorry to hear about all your problems. I don't imagine that it is a lot of fun getting your car towed. How long have you had the car? How many miles are on it? Did you buy it new? Have you been having problem all along, or is this something recent?
I have had the same two cars as you, a 2000 328i and a 2005 545i. I had 80,000 miles on the 328i when I traded it in for my 545i. Both car have been nearly trouble free.

yes i did buy my car new, and it has just over 27000 miles on it and i have had my car since june 04. All of these problems have occured over the past few months and it is very embarassing getting your bmw towed, so many people stopped and asked me if i was lost and the reaction on their faces when i told them i broke down are unforgettable. As for the 328i i still have it and it is approaching 180000 miles and is still trouble free

Sorry about your problems. Have you had anything done to your car recently? Did it start after you had something done (upgraded the progman, changed any components, motors etc.) ?
Just curious.
My SA and I were talking about how these cars are quirky in that once a component is replaced, an upgrade must be done for the system to recognize the new component. The problem is the upgrade may or may not be compatible with the other (older) components. It's the reason I'm reluctant to get the iPod upgrade on my car. I don't want to upset the apple cart...

no i didnt have any mods or work done to my car, and i am definately not going back to lexus, unless they start making manual trannys

I recieved a call from the dealer today and they said that the entire clutch assembly is bad, anyone know how that can happen?
