I really did not notice it as an issue, simply the transmission responding to my driving style. When I tone down my acceleration to a more conservative driving style, the RPMs at which the shifts take place also drop, both in D and DS.

I have a 530i step, and notice the same thing. I just had the latest software upgrade a week ago, v 12 something. Didn't do anything. Here's how you have to drive in traffic - Really press the pedal to get it going, then slam on the brakes before you hit someone in front of you... Fast, slow, fast, slow. Either that or just go real slow off a dead standstill and look like a grandma driving as Buick in front of you pulls away fast from you......

I hate to say it, and I don't want to believe it, but I think this is just 'How it is'......Even though it shouldn't be on a 51K car.

Yes, the RPMs do shift down quickly when I let off the gas but I would the gears to shift and come bring down the RPMs even when I keep a steady pressure on the pedal. It seems I have to either back off the pedal or force a shift by pushing down on the gas quite a bit more than what feels comfortable.

Maybe, it is the active transmission trying to be too smart for its own good.

This may be heresy, but I test drove an Audi A6 (which overall I found to be certainly not upto par with the E60) and I must say it had an amazing pedal feel to it. A light touch and it was out the door in a flash!

Oh, well, I hope the dealership responds to my complaint!
