The Fog is finally clearing for all the N54 owners ( at least with march 08 or earlier builds) over the " non existent" lag from the newer DMS software (29.2+) .

We all need to thank the E90post.com turbo users for Finally getting the BMW CCA to investigate , and "Leverage" BMW with a threat to release all the info and complaints about the software in January's Roundel. That seemed to do the trick.
Not every one will be happy , since it only addresses the 08's up to March build ( new ECU version rev81 starts here), and some people still want the Waste gate rattle fixed AND the original lag free turbos...
At least it is a first step in the right direction.

I bought my 550i based in part (small part, really) on my test drives of 535i and noted slight turbo lag under certain conditions. I reported my experiences here which resulted in severe ridicule etc. by owners. Ho hum.

BMW North America Statement:
"In an effort to address specific noise concerns, BMW updated the turbocharged engine software on 335i/xi and 535i/xi models built from June 2006 through March 2008. The updated software causes a small amount of increased "turbocharger lag" under certain circumstances and, while not substantial, the lag may be perceptible to the most sensitive BMW drivers. X6, 135i, and 3 Series/5 Series vehicles from March 2008 production onward are not affected. Release of the new software to restore the original turbocharger response is planned for January 2009, and it will be available for vehicles produced from September 2007 through March 2008 when they are brought to an authorized BMW center for a repair which requires a programming update. Clients with vehicles produced from June 2006 through September 2007 may request installation of the January 2009 software update. Clients who get this update should understand that there is a possibility of slightly increased engine noise levels under certain circumstances."
I will be bringing in my e60 for service around that time. Hope I can get the update then....

I have an 03/08 build as well. I'm guessing it would have to do with whether or not you have MSD 80, or 81. I know there are 03/08 builds out there with both versions. I have MSD 81 so I believe I'd be excluded, but I'm not sure.
