520D 2008 Cruise Control doesn't work

Hello,
Please be kind, as I'm a newby in this and also english is not my native language.
I'm living in Ireland and I just purchased my first BMW 520D LCI 2008 model, and everything works well, except I noticed that CC doesn't work.
When I'm trying to activate cruise control at any speed over 40 km/h I get this sign as seen below, but the CC doesn't activate. I've checked all fuses, no problems on that. What could be the reason this is happening. No other warning on board, service status OK, no errors.

Is it a manual transmission or automatic? If a manual, I believe the clutch pedal has two switches on it, one to let it know when you've begun to press the pedal and another for when it is fully depressed. Any chance the first one thinks the clutch is pressed in and so it doesn't engage? I wouldn't expect it to show you that image if that was the case though...

What do you mean by no errors? Have you hooked up INPA to see if a module had any messages. The CC wouldn't give you an error in iDrive. Unplug the car for 15 mins to reset it.

I forgot to mention that I got this warning when I navigate to service menu and try to activate cruise control.

Yes. Something is going on with the transmission that is why it is not engaging. You should of been able to shift it to 6th gear and then engage it. He should of been able to see errors on the trans module

When in drive push the gear lever to the left to put it in manual and shift up
