That's very low mileage, certainly. Was it a loaner or something? I would be curious about why it's back on the lot. There was an 08 on Autotrader for around $38K recently. I don't remember the mileage, but as I recall it had more options. Depends a bit on whether you are willing to travel, and how comfortable you are buying a non-local car if that's what it takes. Another option is to find a dealer willing to watch for a good deal at the BMW auctions (among the lease returns).

Actually sounds a little steep, but the miles are low and if you're happy with it that's all that really matters. I would think high 30's would be more appropriate -- the MY 2010's are here.

So a 5er depreciates about 30% in the first year?

this car is in CT, actually i saw another in jersey, about same mileage but sold the week i wanted to test drive, little more options, 43k as well, i was thinking getting a new 2009 with 0.9% and first two months on bmw, but this 2008 still get me lower payment, and 3000 miles is still new

i also saw the 38k on autotrade, but the title is not clean, and i want white color, it really took me long time to make this decision

i think maybe because bmw have promotion for new car, like lower rate, so used car need to be lower in order for people to buy

I think you made a very good deal. Seems like a wise decision and you will get a lot of good use and enjoyment out of the car. Good luck.
